A draft amendment to the Temporary Residence Permit (TRP) Issuance Rules has been published on the Open Regulatory Legal Acts portal. The proposed changes ease certain requirements for foreign nationals while introducing additional checks for labor migrants.

Key Updates:

  • Extended Grace Period for Overstays
Previous rule: Applications were rejected if the overstay exceeded 10 days.
New rule: Rejection only applies after 30 days of overstay.
Note: Administrative penalties for overstays remain in effect.

  • New Valid Grounds for TRP Applications
Applicants may now file for a TRP if errors were caused by the service provider (e.g., technical issues during document processing).

  • Leniency for Minors (Aged 16–18)
Automatic rejection will no longer apply if:
The minor was charged under Article 517 of the RK Administrative Code (minor offenses);
The court dismissed the case due to insignificance.

  • Stricter Verification for Labor Migrants
For employment-based applications: Cross-checking data in the hr.enbek.kz system; discrepancies may lead to refusal.
For EAEU nationals: Employment certificates must state "No permit required" or "Citizen of an EAEU member state."

Implications for Foreign Nationals:

  1. More flexibility – Extended deadlines to rectify mistakes.
  2. Protection against technical errors – Applications accepted even if the fault lies with the service provider.
  3. More leniency for minors – Reduced risk of denial over minor violations.
  4. Tighter scrutiny for labor migrants – Mandatory verification via Enbek.kz.

Note: The amendments are not yet in force, but businesses and migrants should review the new requirements in advance.
