The Prosecutor's Office of North Kazakhstan Region has uncovered serious violations of labor legislation: 1,837 companies in the region failed to register 6,517 employees in the Unified System for Recording Employment Contracts (USREC) . These people are actually working, and employers are making pension and social contributions for them, but officially their employment relationships are not reflected in the state system.

This is not an isolated case — the violations are widespread and indicate a systemic problem in HR administration.

Fines are imposed for:

  • failure to submit or late submission of information to the USREC;
  • submission of incomplete data;
  • submission of inaccurate or incorrect information.

Deadlines Established by Law

The law sets clear deadlines for entering information into the USREC :

  • for concluding an employment contract — no later than 5 working days from the date of signing;
  • for amendments and additions — no later than 15 calendar days from the date of signing;
  • for termination of an employment contract — no later than 3 working days from the date of termination.

Consequences for Employees and Businesses

When employee data is missing from the USREC, it creates serious risks:

  • For employees — inability to confirm work experience for pensions, benefits, and sick leave; difficulties with loans and mortgages; risk of being left without protection in case of salary delays or unlawful dismissal.
  • For businesses — fines up to 865,000 tenge for repeated violations; risk of legal disputes with employees; reputational damage.

The Prosecutor's Position

The North Kazakhstan Prosecutor's Office issued an order to the State Labor Inspectorate recommending that all 1,837 companies be notified of the violations and measures be taken to address them. The Chamber of Entrepreneurs has also been involved, and its experts strongly recommend that managers check the availability of employee data in the USREC and bring their HR documentation into compliance with legal requirements in a timely manner to avoid administrative penalties.
